Retail & wholesale orders

These Terms & Conditions apply to purchases made from MASA Tortillas through both our retail and wholesale websites. They explain the terms that apply when you order from us and should be read alongside our Returns & Refunds, Privacy & Cookie and Delivery Help policies.

Who these terms apply to

MASA Tortillas is a trading name of The Little Tortilleria Ltd, a company registered in England and Wales under company number 13808662, VAT number GB 429938251.

These terms apply to both masa-tortillas.co.uk and wholesale.masa-tortillas.co.uk.

1. Retail and wholesale customers

Some of our terms differ depending on whether you are purchasing as a consumer or as a business.

A retail customer is someone purchasing principally for personal use rather than for purposes connected with their trade, business or profession.

A wholesale customer is a business or person purchasing products principally for use or resale in connection with a trade, business or profession.

Where a section applies only to retail or wholesale customers, we make this clear. Nothing in these terms affects any statutory rights that cannot legally be excluded or restricted.

2. Placing an order

Products displayed on our websites are subject to availability.

When you place an order, you are making an offer to purchase the products in that order.

We may decline or cancel an order where reasonably necessary, including because of:

  • Product availability
  • Production capacity
  • Payment problems
  • Pricing or website errors
  • Suspected fraud
  • An inability to deliver to the address supplied

If we cancel an order after payment has been taken, we will refund any amount due.

You are responsible for ensuring that the information supplied with your order, including your delivery address and contact information, is accurate and complete.

3. Prices and payment

Prices are shown on the relevant website and may change from time to time.

The applicable price is normally the price displayed when your order is placed, except where there is an obvious pricing or technical error.

Any applicable VAT and delivery charges will be shown during checkout.

Payment must be made using one of the payment methods offered at checkout or, where agreed with a wholesale customer, by another payment arrangement agreed with us.

We may withhold production or dispatch where payment is due but has not been successfully received.

4. Fresh and perishable products

Many MASA products, including our fresh tortillas, are fresh and perishable food products.

Customers must follow the storage and handling instructions supplied with the products. In particular, products marked as requiring refrigeration should be refrigerated promptly following delivery.

Best-before dates relate primarily to product quality rather than automatically indicating that a product becomes unsafe on that date.

Because some of our products are perishable, different cancellation and return rules may apply to them. Full details are provided in our Returns & Refunds Policy.

5. Delivery

Delivery dates and transit times shown on our websites are estimates or delivery aims unless we expressly state that a particular service is guaranteed.

Retail orders are generally sent using Royal Mail and wholesale courier orders are generally sent using APC. We may use alternative delivery providers where appropriate.

Once an order has been handed to a third-party carrier, delays can occasionally occur which are outside our direct control.

Customers are responsible for providing a complete and accurate delivery address and for taking reasonable steps to receive, collect or rearrange delivery of a parcel where required.

This does not affect any rights or remedies that cannot legally be excluded.

6. Retail Freshness Guarantee

Retail packs of MASA tortillas are covered by our voluntary Freshness Guarantee, subject to its terms.

Where qualifying tortillas spoil before their stated best-before date despite having been received, handled and stored correctly, MASA may provide replacement tortillas or store credit in accordance with the Freshness Guarantee.

Correct storage, including prompt refrigeration where instructed, is a condition of the voluntary Freshness Guarantee.

The Freshness Guarantee is additional to, and does not replace or restrict, any statutory rights available to consumers.

7. Wholesale Fresh Delivery Guarantee

Eligible wholesale courier orders may be offered the option to purchase our Fresh Delivery Guarantee at checkout.

Where purchased, the guarantee provides the remedies described in the Fresh Delivery Guarantee terms if an eligible courier delay causes qualifying premature spoilage.

Customers must follow the delayed-delivery procedure set out in those terms.

The Fresh Delivery Guarantee is an optional service provided by The Little Tortilleria Ltd in connection with products purchased from us. It is not a cash compensation scheme.

Where the guarantee applies, the remedy is replacement of the affected tortillas or account credit in accordance with its terms.

8. Wholesale orders

The following additional terms apply to wholesale customers.

  • Wholesale orders are subject to production capacity and product availability.
  • Products supplied through our wholesale store are intended for business customers.
  • Wholesale customers are responsible for ensuring that products are stored, handled and, where applicable, sold or served in accordance with the storage instructions and food-safety information supplied with them.
  • Unless otherwise agreed with us, payment must be received in accordance with the payment method and terms applicable to the order before we are required to produce or dispatch it.

9. Wholesale standing orders and Direct Debit

For wholesale standing-order customers:

  • We require one full week's notice to set up or cancel a Direct Debit standing order or to start or cancel a recurring wholesale order.
  • We require at least one week's notice for requested increases or decreases to a recurring order.
  • Increases are subject to available production capacity.
  • Direct Debit payments will normally be scheduled for collection shortly before the relevant production date.
  • If a Direct Debit payment fails or is cancelled, we may suspend the associated tortilla order until payment arrangements have been resolved.
  • If a recurring order is paused, the customer's previous production capacity cannot necessarily be reserved. Restarting the order will therefore be subject to available capacity at that time.

10. Changes and cancellations

Retail and wholesale cancellation rights can differ, particularly where fresh or perishable goods are involved.

Our Returns & Refunds Policy explains the applicable cancellation, return, replacement and refund procedures.

Nothing in these terms removes any cancellation or refund rights which apply by law.

11. Product information

We take reasonable care to ensure product descriptions, photographs, prices and other information on our websites are accurate.

Images are illustrative and colours and appearance may vary slightly from the product received.

We may change product recipes, packaging, specifications, availability or prices from time to time.

Customers with allergies or dietary requirements should always check the information supplied with the product before consuming or serving it.

12. Website accounts

You are responsible for maintaining the confidentiality of your account details and for activity carried out through your account.

You must provide accurate information and keep relevant account and contact details reasonably up to date.

We may suspend or close an account where we reasonably believe it is being used fraudulently, unlawfully or in breach of these terms.

13. Acceptable use of our websites

You must not misuse our websites, attempt to gain unauthorised access to them, knowingly introduce malicious software, interfere with their operation or use them for unlawful purposes.

All intellectual property rights in MASA branding, website content, photographs, graphics and other materials belonging to us remain our property or that of the relevant rights holder.

14. Third-party services and links

Our websites may contain links to or integrations with third-party websites and services, including payment providers, delivery companies and other service providers.

Those third parties may operate under their own terms and privacy policies.

We are not responsible for the content of independent third-party websites merely because we link to them.

15. Privacy and cookies

We process personal information in accordance with our Privacy & Cookie Policy.

Our websites also use cookies and similar technologies for purposes including operating the websites and shopping baskets, maintaining security and, where permitted, analytics and other functionality.

Where consent is required for cookies or similar technologies, we will provide an appropriate means for visitors to make their choices.

16. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights which cannot legally be excluded.

For retail customers, we are responsible for losses which are a foreseeable consequence of our breach of contract or failure to use reasonable care and skill.

We are not responsible for business losses suffered by a consumer using products principally for personal purposes.

For wholesale customers, to the fullest extent permitted by law, we will not be liable for indirect or consequential business losses, including loss of profit, revenue, sales, business opportunity or goodwill arising from a delivery delay, product shortage or other breach.

Nothing in this section affects liability which cannot legally be excluded or restricted.

17. Events outside our reasonable control

We will not be responsible for a failure or delay in performing an obligation where this is caused by circumstances outside our reasonable control.

These may include:

  • Severe weather
  • Transport or courier disruption
  • Industrial action
  • Utility or telecommunications failures
  • Fire or flood
  • Government action
  • Major supply-chain disruption
  • Similar events outside our reasonable control

Where such circumstances affect an order, we will take reasonable steps to minimise the effect and communicate with customers where appropriate.

This section does not remove rights or remedies that cannot legally be excluded.

18. Returns, refunds and problems with an order

Our procedures for damaged, incorrect, missing or unwanted goods, cancellations, refunds and other order problems are contained in our Returns & Refunds Policy.

19. Changes to these terms

We may update these Terms & Conditions from time to time, for example to reflect changes to our services, websites or applicable law.

The version applying to an order will normally be the version in force when the order was placed.

The current version will always be available on this page.

20. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

21. Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer, you retain any mandatory legal protections and rights concerning where proceedings may be brought which apply to you.

For wholesale customers, the courts of England and Wales will have exclusive jurisdiction, except where applicable law requires otherwise.
